Terms of Service

Agreement to Terms

These Terms of Service ("Terms") are an agreement between you and Viet Anh Tran (ABN 95 813 859 194), trading as "Lati" ("Lati", "we", "us"), and govern your use of the Lati mobile application and services ("Service"). By accessing or using Lati, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use our Service.

Eligibility

To use Lati, you must:

• Be at least 13 years old (users under 18 require parental consent)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

By creating an account, you represent and warrant that you meet these requirements.

Account Registration and Security

When you create an account:

• You must provide accurate, current, and complete information
• You are responsible for maintaining the security of your account credentials
• You must not share your account with others
• You must notify us immediately of any unauthorized access
• You are responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You Agree To:

• Use Lati only for finding and coordinating sports activities
• Treat other users with respect and courtesy
• Show up to games you commit to joining
• Leave honest venue reviews when you choose to submit one
• Comply with all applicable laws and regulations
• Respect others' privacy and safety

You Must Not:

• Harass, bully, threaten, or intimidate other users
• Post offensive, discriminatory, or illegal content
• Impersonate others or create fake accounts
• Use Lati for commercial purposes without authorization
• Spam, solicit, or advertise without permission
• Attempt to access unauthorized parts of the Service
• Interfere with or disrupt the Service
• Scrape, copy, or reverse engineer the app
• Use bots or automated tools
• Post sexual, violent, or inappropriate content
• Use Lati for dating or romantic purposes (use dedicated dating apps instead)

User Content

You retain ownership of content you post (messages, photos, etc.). However, by posting content, you grant Lati a worldwide, non-exclusive, royalty-free license to:

• Display, distribute, and store your content within the Service
• Use your content for app improvement and analytics (anonymized)
• Moderate, remove, or flag content that violates these Terms

You represent and warrant that:

• You own or have rights to the content you post
• Your content does not violate any laws or third-party rights
• Your content does not contain malware or harmful code

Community Standards

Lati may use signals such as attendance, cancellations, conduct, and participation to support community trust and safety. The way these signals are calculated, weighted, or displayed may change over time.

Please respect the community. If you commit to a game, show up. Emergency cancellations are understandable, but repeated no-shows or misconduct harm other players and may result in warnings, restrictions, or account termination.

Reporting, Blocking, and Content Moderation

Lati includes user-generated content such as profiles, messages, photos, and videos. We do not tolerate objectionable content or abusive behaviour.

• You can report a user or content directly in the app
• You can block another user to stop further contact
• We aim to review reports of objectionable content and take appropriate action within 24 hours, which may include removing content and suspending or terminating the responsible account
• We may investigate, remove content, restrict features, or terminate accounts at our discretion to keep the community safe

By using Lati, you agree there is no tolerance for objectionable content or abusive users, and that we may act on reports as described above.

Payments and Purchases

Lati is free to download and use for core features. Some optional paid features are available:

• Tips: You may choose to send an optional one-off tip to support the app. Tips are processed by Apple as in-app purchases and are subject to Apple's terms.
• Venue bookings: Where offered, payments for venue bookings are processed by our payment provider (Stripe). Your card details are handled by Stripe and are not stored on our servers.

Prices are shown before you confirm a purchase. Refunds for in-app purchases are handled in accordance with Apple's policies; other refunds are subject to applicable law, including any non-excludable rights under the Australian Consumer Law.

Safety and In-Person Meetings

Safety Guidelines:

• Meet in public, well-lit locations (courts, parks)
• Tell someone where you're going and when you'll return
• Trust your instincts - if something feels off, leave
• Do not share personal information (home address, financial details)
• Report suspicious behavior immediately
• Bring your own water and equipment when possible

Lati is not responsible for in-person interactions. We provide a platform to connect, but cannot guarantee the behavior of users. Use common sense and stay safe.

Intellectual Property

All rights, title, and interest in Lati (including the app, logo, design, code, and features) belong to Lati or our licensors. You may not:

• Copy, modify, or create derivative works
• Remove or alter any proprietary notices
• Use our trademarks without written permission
• Reverse engineer or decompile the app

Third-Party Services

Lati integrates with third-party services, including Apple (Sign in with Apple, push notifications, and in-app purchases), Stripe (payments), and Cloudflare (hosting). Your use of these services is subject to their own terms and privacy policies. We are not responsible for third-party services.

Disclaimers and Limitation of Liability

Service "As Is"

Lati is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results will be accurate or reliable
• Any errors will be corrected
• The Service meets your specific requirements

Limitation of Liability

To the maximum extent permitted by law, Lati and its affiliates shall not be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Physical injury or property damage arising from use of the Service
• Actions or inactions of other users
• Third-party content or services

Physical Activity Warning: Sports involve physical risk. You participate at your own risk. To the maximum extent permitted by law, Lati is not liable for injuries, accidents, or damages that occur during games.

Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. Where our liability for breach of a non-excludable guarantee can be limited, it is limited (at our option, to the extent permitted) to re-supplying the relevant service or paying the cost of having it re-supplied.

Indemnification

You agree to indemnify and hold harmless Lati and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any laws or third-party rights
• Your use of the Service
• Content you post or transmit

Termination

We may suspend or terminate your access to Lati at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Repeated no-shows or misconduct
• Requests from law enforcement
• Technical or security reasons

You may terminate your account at any time by:

• Deleting your account in app settings
• Contacting support at contact@getlati.com

Upon termination, your right to use the Service ceases immediately. Provisions regarding liability, indemnification, and dispute resolution survive termination.

Dispute Resolution

Informal Resolution

If you have a dispute, please contact us at contact@getlati.com to attempt informal resolution before pursuing legal action.

Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia. If a dispute cannot be resolved informally, you and Lati submit to the non-exclusive jurisdiction of the courts of Victoria, Australia. Nothing in this section limits any right you may have to bring a claim in another forum where that right cannot lawfully be excluded, including under the Australian Consumer Law.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms in the app
• Updating the "Last Updated" date
• Sending an in-app notification (for significant changes)

Your continued use after changes constitutes acceptance of the new Terms.

General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Lati
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• Waiver: Failure to enforce any right does not waive that right
• Assignment: You may not assign these Terms; we may assign without restriction
• No Agency: These Terms do not create a partnership, agency, or employment relationship
